Large Jump in EB-3 Visa Availability

Individuals in the EB-3 category should take special interest in the May 2008 Visa Bulletin, which was just released. Most individuals in this category with a priority date before March 1, 2006 are eligible to complete their application process (the date was previously July 1, 2005) [Please note that for those from China, India and Mexico the date is still in 2001, 2002 or 2003].

According to the Visa Bulletin, employment cut off dates have advanced faster than usual as a result of consultations with US Citizenship and Immigration Services. USCIS has indicated that they want to review a significant number of cases at this time in order to ensure that number use in the various categories can be maximized. While this is welcome news, the Visa Bulletin also states that should USCIS miscalculate the resulting number use, cut-off dates in the EB-3 category could be pushed back. USCIS has had a history of adjusting cut-off dates shortly after a Visa Bulletin is released.

We therefore encourage individuals who believe they are eligible to apply for a Green Card under the EB-3 category to contact us immediately in order to prepare and file their applications before cut-off dates are adjusted.
