Immigration Benefits for Same Sex Couples?
We have been watching for this for a long time. Currently even if people are legally married elsewhere, or even in a US state that recognizes same sex marriage, the US immigration system will not extend immigration benefits to the couple. We have been trying to encourage people to at least apply and then when denied challenge the basis for the denial. Well, the wait may finally be over. Someone is challenging the 1996 Defense of Marriage Act. Even President Obama has said he would work to undue this legislation. This case focuses on equal protection for federal benefits, and even though it does not arise in the immigration arena, the result may finally bring immigration benefits to same sex couples.
